Terms of Service

1. Agreement

By using this website or engaging Top Shelf Productions LLC for video production, photography, post-production, creative direction, or related services, you agree to these Terms of Service. If you do not agree, please do not use the site or our services.

2. Services and deliverables

Top Shelf Productions LLC provides creative production services as described in your proposal, statement of work, or written agreement. Specific deliverables, usage rights, timelines, and revision allowances will be defined in that contract. While we work diligently to meet deadlines, factors such as client feedback timing, third-party locations, weather, or platform review processes may affect schedules and are outside our sole control.

3. Fees and payment

Fees, deposits, and payment schedules are set out in your agreement with Top Shelf Productions LLC. Unless otherwise stated, production may not commence until agreed deposits are received. Late payment may pause work or delay delivery of final masters. Third-party costs (locations, talent, music licensing, hard drives, etc.) may be billed separately as approved in advance.

4. Intellectual property

Upon full payment for the applicable scope, client rights to finished deliverables will be as specified in your agreement (for example, web use, broadcast, or social placements). Top Shelf Productions LLC retains rights to underlying methods, internal templates, and pre-existing tools. Raw footage or project files may be archived according to the agreement; additional licensing or buyouts can be negotiated in writing.

5. Limitation of liability

To the fullest extent permitted by law, Top Shelf Productions LLC is not liable for indirect, incidental, or consequential damages arising from use of this site or our services. We are not responsible for issues caused by client-supplied materials, third-party platforms, or force majeure events. Liability for any claim relating to a project is limited to the fees paid to Top Shelf Productions LLC for that specific engagement, except where prohibited by law.

6. Termination

Either party may terminate an engagement as set forth in the written agreement (often including notice and payment for work completed to date). Upon termination, Top Shelf Productions LLC will cooperate on a reasonable handoff of project materials as contractually required.
